Edward Yearly, aged 29, a former Olivetti PC engineer of Hemel Hempstead, was convicted last month of gaining unauthorized access to computer material in October, 1994. He was charged under the Computer Misuse Act. In Bow Street Magistrates Court this week, the court heard how Yearley went to the PC maintenance department at Marks & Spencer's Harrow branch in 1994. During the visit, he copied security information files to a floppy disk. Later, he posted the file to the Gates of the Underworld bulletin board system where he was known as "Mr Ed." Crown solicitors said that the file was instantly traceable to the Harrow branch of Marks & Spencer's. Later, when undercover police officers logged onto the underground BBS, which was supposed only accessible to hackers paying an annual fee, they discovered the file that "Mr Ed" had posted. After subsequent investigation, Yearley's home was raided by police and his home PC and significant quantities of floppy disks were confiscated. In court, Yearley denied being a member of the Gates of the Underworld BBS, but admitted to being a member of other BBSs. Police were able to prove to the court that "Mr Ed" was Yearley's nickname on the BBS and that the file on his PC was the same one uploaded to the BBS. Paul Clark, the Magistrate in the case, said that there was an element of breach of trust that Yearley had broken. "It's fair to say that a certain amount of knowledge and expertise is needed to commit an offense such as this," he said. Clark went on to say that there was no question of personal profit for Yearley, and no gain and no loss to Marks & Spencer. "But the scope for other people to misuse the information that was downloaded is hard to judge," he told the court. Yearley was sentenced to 70 hours community service and ordered to pay UKP 170 costs to the prosecution; his computer was also released from police custody. "Although your own personal computer was seized and evidence gathered from it, your own computer was not used for committing the offence or facilitating it," the Magistrate noted. What the hell. Mistake 2: Posting the information on a lame board. Mistake 3: Not encrypting valueable information of that sort. Mistake 4: By lying in court, his ass was cooked anyways. I mean I would probably lie too, but when he did and they had proof that he was the guy, he only buried his ass a deeper hole to shit in. Mistake 5: He didn't send his information to ROT where it would have been protected correctly disposed of if any government officials were to try and obtain it.
