New Frontiers ***** Shareware Explorer ***** Electronic Bulletin Board System License The use of The New Frontiers Shareware Explorer CD-ROMs on electronic bulletin board systems (BBS) is prohibited without a license from New Frontiers. This License Agreement is between New Frontiers nd the BBS operator whose signature appears at the end of this Agreement. In return for the limited right to use The New Frontiers Shareware Explorer CD-ROM the BBS Licensee agrees to the provisions of this License. This Agreement allows the BBS Licensee to use The New Frontiers Shareware Explorer CD-ROM for the period of one year from the date of this License. 1. New Frontiers CD-ROMS's copyright covers the research, editing, organization and compilation aspects of New Frontiers Shareware Explorer CD-ROM as well as any individual programs or descriptive materials which are the original creation of New Frontiers. Unless otherwise specified, New Frontiers does not claim literary rights in individual programs which have been licensed for use. 2. This License Agreement allows the BBS Licensee to use New Frontiers name, file organization system and corresponding titles, and New Frontiers developed text files including, but not limited to, file descriptions. 3. BBS Licensee agrees to respect the author's copyright notices on the Shareware software and New Frontiers copyrights and trademarks. New Frontiers copyrighted materials include the directory on disk, and all printed directories and encyclopedias. 4. The BBS Licensee must have the capability, and agree, to deny access to any program, or file on their BBS system that has been withdrawn from The New Frontiers Shareware Explorer disc. Notification of program, file, withdrawal from The New Frontiers Shareware Explorer CD-ROM will be sent to Licensee. It is the responsibility of the BBS Licensee to maintain their BBS according to the current distribution status as reflected in those Notices. 5. BBS Licensee agrees not to download files and/or programs from the New Frontiers Shareware Explorer disc with the intent to sell the copy. Downloading is defined as the process of copying or duplicating a file from New Frontiers Shareware Explorer CD-ROM disc onto other media, including, but not limited to, diskettes, hard drives, magnetic tape or optical disc, for the intentional or unintentional purposes of sales, distribution or financial gain. The BBS Licensee cannot side-step the issue of a sale by claiming that they have only charged for consulting time, the cost of the diskette, online time, or for labor charges only. 6. Because of the varying types of hardware and software for BBS systems, New Frontiers CD-ROMS does not guarantee the compatibility of The Shareware Explorer CD-Rom with any particular BBS system. 8. If Licensee violates any provisions of this Agreement, New Frontiers can terminate this License and continued violations may possibly lead to subsequent legal action by New Frontiers, among other causes of action, for violation of New Frontiers License, registered trademark(s) and/or copyright(s). 9. The License fee is as follows: - $ 1 per year for any BBS system. This minimal license fee is intended to cover the administrative costs of notifying you of file defects, Author requested removals, commercial programs, etc. Reasonable care has been taken in the production of this CD-ROM disc, but rapid notification of any potential problems is in the best interests of both the BBS operator and the CD-ROM producer. Each bulletin board system is only required to pay a single fee to use any and all of our line of premium CD-ROM products. For example, a purchaser of both volumes 1 & 2 of the MS DOS CD-ROM who runs a BBS system will only pay a an annual fee of $1 to run both CD-ROMS on his system. You need only pay once, but a seperate license form must be completed and returned for each CD-ROM disc you run on-line. License fees are due and payable within 30 days of your purchase of this CD-ROM disc. All licenses are non-transferrable. 10. Licensee agrees to notify New Frontiers CD-ROMS, if they have or gain knowledge of individuals or organizations that are violating the terms of this License Agreement or New Frontiers copyright(s) and/or trademark(s). 11. Should legal action result between New Frontiers CD-ROMS and its Licensee due to the violation of, or concerning, any of the provisions of this Agreement, the Licensee shall be responsible for all attorneys fees and related legal expenses, including, but not limited to, loss of business and profit to New Frontiers CD-ROMS. Should litigation be necessary, any action will be filed in the County of Litchfield, State of Connecticut. 12. The New Frontiers CD-ROMS Shareware CD-Rom is not licensed for use on BBS systems operating outside the USA. For other countries, contact New Frontiers CD-ROMS for any special local license requirements. New Frontiers CD-ROMS reserves the right to limit the number of licenses granted in selected geographic areas of the world. No BBS licenses will be issued in the state of Connecticut. 13. This License shall be construed under the laws of the State of Connecticut.
