The PC-SIG Library Electronic Bulletin Board System License The use of The PC-SIG Library on CD ROM on electronic bulletin board systems (BBS) is prohibited without a license from PC-SIG, Inc. This License Agreement is between PC-SIG, Inc. and the BBS operator whose signature appears at the end of this Agreement. In return for the limited right to use The PC-SIG Library, the BBS Licensee agrees to the provisions of this License. This Agreement allows the BBS Licensee to use The PC-SIG Library for the period of one year from the date of this License. 1. PC-SIG's copyright covers the research, editing, organization and compilation aspects of PC-SIG Library diskettes and CD ROMs as well as any individual programs or descriptive materials which are the original creation of PC-SIG. Unless otherwise specified, PC-SIG does not claim literary rights in individual programs which have been licensed for use. 2. This License Agreement allows the BBS Licensee to use PC-SIG's name, diskette numbering system and corresponding titles, and PC-SIG developed text files including, but not limited to, diskette descriptions. 3. BBS Licensee agrees to respect the author's copyright notices on the Shareware software and PC-SIG's copyrights and trademarks. PC-SIG's copyrighted materials include the directory on disk, all printed directories and encyclopedias, PC-SIG Hotsheet, PC-SIG Magazine and Shareware Magazine. 4. The BBS Licensee must have the capability, and agree, to deny access to any program, file, or diskette on their BBS system that has been withdrawn from The PC-SIG Library. Notification of program, file, or diskette withdrawal from The PC-SIG Library will be published in "Shareware Magazine" and/or the PC-SIG Hotsheet that is sent to Licensee. It is the responsibility of the BBS Licensee to monitor the above publications and to maintain their BBS according to the current distribution status as reflected in those publications. 5. BBS Licensee agrees to display the PC-SIG Introduction Screen prior to the initial downloading of software by each user. The PC-SIG Introduction screen will be supplied in ASCII format on diskette. 6. BBS Licensee agrees not to download files and/or programs from a PC-SIG diskette or The PC-SIG Library on CD-ROM disc with the intent to sell the copy. Downloading is defined as the process of copying or duplicating a PC-SIG Library diskette or The PC-SIG Library on CD-ROM disc onto other media, including, but not limited to, diskettes, hard drives, magnetic tape or optical disc, for the intentional or unintentional purposes of sales, distribution or financial gain. The BBS Licensee cannot side-step the issue of a sale by claiming that they have only charged for consulting time, the cost of the diskette, online time, or for labor charges only. 7. BBS Licensee agrees not to charge any fees for downloading and/or viewing any portion of The PC-SIG Library, nor are they allowed to charge any access fees. BBS operators may, however, charge a nominal annual membership fee, which is not to exceed $50.00 to help defray the cost of the system operation. 8. Because of the varying types of hardware and software for BBS systems, PC-SIG does not guarantee the compatibility of The PC-SIG Library on CD-ROM with any particular BBS system. 9. If Licensee violates any provisions of this Agreement, PC-SIG can terminate this License and continued violations may possibly lead to subsequent legal action by PC-SIG, among other causes of action, for violation of PC-SIG's License, registered trademark(s) and/or copyright(s). 10. The License fee is twenty dollars ($20) per year for a one line BBS system. For BBS systems with more lines, the fee is an additional one hundred dollars ($100) per added line per year. 11. Licensee agrees to notify PC-SIG, Inc., if they have or gain knowledge of individuals or organizations that are violating the terms of this License Agreement or PC-SIG's copyright(s) and/or trademark(s). 12. Should legal action result between PC-SIG and its Licensee due to the violation of, or concerning, any of the provisions of this Agreement, the Licensee shall be responsible for all attorneys fees and related legal expenses, including, but not limited to, loss of business and profit to PC-SIG, Inc. Should litigation be necessary, any action will be filed in the County of Santa Clara, State of California. 13. The PC-SIG Library is not licensed for use on BBS systems operating outside the USA. For other countries, contact PC-SIG for License requirements. 14. This License shall be construed under the laws of the State of California. This Agreement sets forth the understanding between PC-SIG and the BBS Licensee; it may be changed or modified only in writing and must be signed by the Licensee.
