Data contained herein was extracted from the "Micropcomputer information for
aircraft maintainers" by Microcomputer applications test & development branch
(325MTS/MATM, Tyndall AFB FL.  POC is MSgt R.W. Pennell 355TTW.

On each disk of shareware, along with the copyright information, there is a 
phrase covering the test period that may state "for a reasonable period of 
time" or for a specific time (usually ranging between 30 and 90 days).  
Although we are not legal experts, it is difficult to imagine any evaluation 
that would require more than 90 days.  And if the documentation specifies 30 
days, that has to be the maximum time you are given for the evaluation.

Several Judge Advocates offices in all branches of government have stated the 
following position on shareware.

"1.  'Shareware' software is protected by the Copyright laws of the United 
States when the author has registered for that protection.  As such, no one 
may infringe upon the copyright by unauthorized use of the software, 
including the United States Government.  The software may only be used 
pursuant to the shareware agreement, wherein the user agrees that the 
software will not be used unless the requested 'donation' or fee is paid.  
The fact that the software is widely disseminated through several public 
sources does not constitute an abandonment of the copyright protection."

"2.  Consequently, any government activity that uses shareware must remit the 
fee or 'donation' through regular purchase channels.  Failure to do so would 
require ratification of an unauthorized commitment by a contracting officer."

"3.  Single use of the program to decide if it is useful does no obligate the 
user to pay, but once the decision is then made to use the program, payment 
of the fee becomes a condition of use.  Wording of the shareware agreement 
such as 'please pay if you like this program' does not make payment 
optional."









FALCON NOTES....

If you upload shareware software ensure the complete package is loaded as you 
received it.  This will include the rules pertaining to its correct handling.  

388 TFW personnel must contact the Wing Small Computer Manager (7-6450) so 
that we can update our database.  If it is not in our database IT IS NOT 
LEGAL!  Contact the above office for a printout of your system should you 
wish to see what software/hardware you are authorized to have.  Please have 
the computer "system ID" or serial number available.

All shareware used by 388 TFW personnel for use on government computers will 
be assigned a serial number and "testing" expiration date (90 days unless 
otherwise specified within the package).

NOTE: Any system within the 388 TFW is subject to inspection at any time for 
copyright infringement.  




