This License applies to the run-time version of Microsoft Video for Windows (SOFTWARE). If you do not agree to this License, you do not have any right to use the SOFTWARE. Microsoft grants to you the right to reproduce and distribute the SOFTWARE provided that you (a) distribute the SOFTWARE only in conjunction with and as a part of a software application product or data file which is created for operation on the Microsoft Windows, Windows NT, or Modular Windows operating systems; (b) do not use Microsoft's name, logo, or trademarks in any marketing or advertising; (c) include a valid copyright notice on your software application product; and (d) agree to indemnify, hold harmless, and defend Microsoft and its suppliers from and against any claims or lawsuits, including attorneys' fees, that arise or result from the use or distribution of your software application product which incorporates the SOFTWARE. You may not distribute the SOFTWARE as part of any operating system, or on a standalone basis. You may not reverse engineer, decompile, or disassemble the SOFTWARE. NEITHER MICROSOFT NOR ITS SUPPLIERS SHALL BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING LOST PROFITS OR INFORMATION, BUSINESS INTERRUPTION, OR OTHER PECUNIARY LOSS, EVEN IF MICROSOFT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. The SOFTWARE is provided with RESTRICTED RIGHTS as set forth in subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software_Restricted Rights at 48 CFR 52.227-19, as applicable.
