ROSS) Subject: File 5--Correction on Clarkson article in CuD #4.46 In CuD #4.46 (September 27, 1992) File #4 was a reprint of the most recent Clarkson Closeup with a question about the "CompuServe Case" mentioned in the "Close-up" write-up. There are inaccuracies in the description of the case which may be the reason the case sounded like news to Rob Woiccak -- and, perhaps, others. The alleged nature of the objectional language was defamatory rather than obscene and the material appeared in an independent newsletter "Rumorville" a "gossip" feature about broadcast journalists. The alleged offense was disparaging comments made about another "gossip" feature called "Skuttlebut." This was the case in which Judge Leisure ruled that CompuServe, like a library or bookstore, is not considered responsible for what it carries. Therefore, CompuServe won its fight to be removed from the suit. I never learned whether the complaint against the "writer" of "Rumorville" was pursued further. I believe his name is Mr. Fitzpatrick. Does anyone know the outcome of the case? Thank you for letting me attempt to correct the inaccuracies. And thanks, Rob, for taking notice and suggesting sources of information.
