Business Group Files General Motors Case Amicus
Ĵ
US Newswire: "The massive punitive damages award against General Motors in
General Motors Corp. v. Moseley was clearly contrary to the interests of
America's businesses and citizens. We call on the Georgia Supreme Court
to overturn $101 million award on the grounds that it will ultimately
make America less competitive," said Kevin L. Kearns, President of the
United States Business and Industrial Council when the Council filed its
Amicus Curaie brief on Dec. 28.

In filing its amicus brief, the Council worked closely with G. Conley
Ingram, former Chief Judge of the Georgia Supreme Court and Ken Starr,
former Solicitor General of the United States.

Massive punitive damages awards like the award in GM v. Mseley do
nothing to serve justice or the public good. The plaintiff and his
attorneys played the lawsuit lottery and hit the jackpot in landing this
multi-million dollar settlement, Kearns continued. "General Motors may
be able to absorb this financial hit. Smaller companies like the
Council's members won't be able to survive the copycat litigation that
will follow like mushrooms follow rain if the Georgia court fails to
strike down this award," Kearns concluded.
