Licence: DATA BECKER hereby agrees to grant you a non-exclusive Licence to use the enclosed DATA BECKER program (the "Program") subject to the terms and restrictions set forth in this Licence Agreement. Copyright: The Program and its documentation are protected by copyright law and international treaty provisions. You may not copy or otherwise reproduce any part of the Program or its documentation, except that you may load the Program into a computer as an essential step in executing the Program on a single computer. Exclusion of Warranty; Limitation of Liability; Limited CD Warranty: Included in the software and the handbook are the users rights and appropriate rules and regulations. Restrictions on Use and Transfer: The original and any back-up copies of the Program and its documentation are to be used only in connection with a single computer. You may physically transfer the Program from one computer to another, provided that the Program is used in connection with only one computer at a time. You may not transfer the Program electronically from one computer to another over a network. You may not distribute copies of the Program or its documentation to others. You may transfer this Licence together with the original and all back-up copies of the Program and its documentation, provided that the transferee completes and returns to DATA BECKER a Registration Card and agrees to be bound by the terms of this Licence Agreement. Neither the Program nor its documentation may be modified or translated without written permission from DATA BECKER. You may not use, copy, modify, or transfer the Program, or any copy, modification or merged portion, in whole or in part, except as expressly provided for in the Licence. Private and non-commercial use: As long as there are no different regulations mentioned in the handbook this software is only for private and non-commercial use. This restriction doesn't apply if the software is designed for commercial use for such things as objects, etc. You are not allowed to rent, lend or advertise the software. Distribution of the software: You are not allowed to sell the software privately or commercially, particularly selling as a gift, and then transferring the user rights of the software to somebody else. The user rights go no further than yourself once the software has been purchased. The distribution is exclusively permitted to follow through the transfer of the original data support (example disc, CD-ROM, DVD). After passing on the software you must immediately delete all the data from all transportable and installed memory (example hard disc, changeable discs, tape, zip media, CD-ROM, disc etc.) which includes to destroy program protection copies and data protection and all occasionally produced copies of the concerned handbook. Internet and Online services: You are not allowed to copy the software in any form to online services or to the Internet including WWW, FTP and USENET and/or any others. This also includes the responsibility of unfavourable agreement changes made to the software or connected with other programs. Intervention in the software: Every design in the software by the user is their responsibility. The use of single elements such as pictures, graphics, sounds: Please note that such pictures, graphics, sounds and videos have their own independent original law protection from the software. Reproduction of sounds is subjected to the reimbursement duty of the GEMA if nothing else is mentioned in the handbook. By no means will DATA BECKER be liable for any action due to legal consequence of any kind as a result of commercial use, especially through you. Elements in your own program, which you want distributed commercially and/or via payment infringes our competitive legal protection rights. Low moral and illegal use: It is absolutely inadmissible to use the software or single pictures, graphics, sound and videos in any form for a working result where they fringe the ruling general moral and decency feelings or the religious opinion of a third party. It is absolutely inadmissible to use the considered materials for working results with pornographic contents or for working results with contents which incites to discrimination of cruelty or any inhuman violence against human beings in any kind described. DATA BECKER guarantees within the legal period and that the software on the computer system has the listed minimum system requirements on the packaging/documentation and the hardware meets required specifications. DATA BECKER warrants the enclosed disk or CD (but not the Program contained thereon) to be free of defects in materials and workmanship under normal use for 30 days after purchase. During the 30-day period, you may return a defective diskette or CD to an Authorised DATA BECKER Dealer, and it will be replaced without charge unless the diskette or CD is damaged by accident or misuse. Replacement of a diskette or CD is your sole remedy in the event of a defect. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Software, which works problem free with all conceivable configurations on all computers doesn't exist. The guarantee doesn't enclose functional restrictions as a result of computer components (Hardware, specially motherboards, graphic cards and sound cards, which represents no standard- trade components) as a result of other programs (particularly through the drive of computer components which represents no standard-trade components) of operating mistakes, improperly treatment or contractual unfavourable use. The program and its documentation is provided "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. The entire risk as to the results and performance of the program is assumed by you. Should the Program or its documentation prove defective, you (and not DATA BECKER or its dealers) assume the entire cost of all necessary servicing, repair, or correction. DATA BECKER is not liable for any data losses and the cost of undertaking any data recovery. Every liability is limited depending on the software purchased and the damage. Neither DATA BECKER, DATA PLAYER LTD, their agents, nor anyone else who has been involved in the creation, production, or delivery of this Program and its documentation shall be liable for any direct, indirect, consequential, or incidental damages (including, without limitation, damages from the loss of business profits, business interruptions, loss of business information, or any pecuniary loss) arising out of the use of or inability to use such products, even if DATA BECKER has been advised of the possibility of such damages or claim. Product Improvements: DATA BECKER reserves the right to make corrections or improvements to the Program and its documentation and to the related diskettes and/or CD at any time without notice and with no responsibility to provide these changes to purchasers of earlier versions of such products. This Licence is effective until terminated. You may terminate it by destroying the Program and its documentation and all copies thereof.
